1. About the service

MinFangst lets you log fishing sessions and catches, save your own fishing spots and build a personal species register. The app is logbook-first, and your logbook is private. Your profile is searchable by default, so that other anglers can find you, and you can add friends (with mutual approval) to compare statistics on a scoreboard. If you would rather not be visible, you turn on Private profile. The core (logbook and species register) can always be used fully in private. What others can see of an open profile or as a friend is described in the privacy policy.

The app also has a mode in which you contribute anonymous species data to a shared database for the benefit of other anglers, researchers and public bodies. The mode is on by default for new users. You are given the choice right after registration, and you can turn it off there or at any time later. In older versions of the app the same mode is referred to as «citizen science».

Built-in databases of Nordic fish species and Norwegian fishing waters ship with the app as an aid. We work to keep them correct, but cannot guarantee that every species, name, water or position is complete or free of errors.

On the map you can also see an estimate of the water temperature in the waters. The feature is in testing (BETA), and the estimates are exactly that, estimates, not facts. You can voluntarily submit your own readings to make the estimates better for everyone. How such submissions are handled is described in the privacy policy.

2. Account

Using MinFangst requires an account. You register with a username, an email address and a password, and the email address must be verified. You can instead create an account and sign in with Apple or Google, in which case you only pick a username at the end. You are responsible for:

• providing correct information when registering,
• keeping your password secret and your account secure, and
• activity that takes place on your account.

Let us know at kontakt@minfangst.no if you suspect that someone unauthorised has access to your account. The very first time you use the app you need a connection to register and sign in; after that the app works offline.

3. Your content

You own your logbook. The content you enter (sessions, catches, notes, photos and spots) belongs to you. We take no ownership of your content, and use it for no purpose other than providing the service to you, as described in the privacy policy.

You grant us a limited right to store, process and synchronise your content between your own devices, so that the app can work. You are responsible for the content you enter being lawful, and for having the right to use any photos.

4. Acceptable use

When you use MinFangst, you agree not to:

• use the app for unlawful purposes or contrary to the law that applies where you are,
• attempt to gain unauthorised access to the service, other accounts or our systems,
• harass or pester other users, or misuse the profile and friend features for unwanted contact,
• circumvent a block, for example by creating a new account in order to contact someone who has blocked you,
• disrupt, overload or damage the operation of the service,
• submit knowingly false or falsified data, for example water temperature readings, that could degrade a shared dataset, or
• attempt to extract, copy or redistribute the built-in reference databases beyond ordinary use of the app.

5. Moderation of shared content

When you share a catch or an observation with your friends, the rules on acceptable use in section 4 apply to what you share as well. Any user can report an entry they consider inappropriate, and we handle such reports within one day.

To assess a report, we may open the entry and see what it contains. We may also open an entry without anyone reporting it, but only when we have a concrete reason, and that reason is then written down and stored. Entries you have marked «private» can neither be reported nor opened by us. If you would rather have nothing to do with a particular user, you can block them. The two of you then disappear from each other's feed and search, and any friendship ends. How such lookups are handled and logged is set out in the privacy policy.

If we consider that an entry breaches these terms, we can hide it. It is then no longer shown to your friends, but it remains in your own journal, and you lose nothing of what you have recorded. In the case of repeated or serious breaches, we may also restrict or close the account, see section 9.

We may also correct details that are plainly wrong, such as a weight or a species that cannot be right. The reason is that such figures feed into the leaderboard, the statistics and the shared species data, where they do harm to everyone else as well. We can change species, weight and length, and remove a note or a photo. We never write new text into your entry, and we do not touch place or position. A copy of the original details is kept so the entry can be restored.

If we hide or correct something, you are notified, and the decision appears with our reasoning under «Decisions about your content» in the app. If you disagree, you can appeal there. We review the case again and answer you in the same place, and if your appeal is upheld we reverse the decision. 6. Responsibility for fishing, rules and safety

MinFangst is a tool for keeping a logbook, not an authority on fishing regulations. You are responsible for following the laws and rules that apply where you fish, among them:

• obtaining a valid fishing licence where one is required,
• observing closed seasons, minimum sizes, quotas and local rules, and
• taking care of your own and others' safety, as well as landowners' rights.

Information in the app, including waters, positions and estimates such as water temperature, is indicative and must not be used as the sole basis for navigation or safety.

7. Backup and loss of data

We synchronise your logbook to the server to mirror it between your own devices, but you are responsible for your own content. We recommend that you do not treat the app as your only copy of important memories or photos. We cannot guarantee against loss of data, for example through device failure, uninstalling the app or unexpected outages.

8. Premium subscription

The core of MinFangst (logbook, catches, sightings, species register, the map, water temperature, reported species and your own spots) is free to use. In addition we offer MinFangst Premium, an optional subscription that unlocks the bite forecast, likely species in the water, season and sizes per species, analysis per species, Your fishing year, weather on site, a weather log on every session and catch, tides, water flow and water level from the gauging stations, depth charts as their own map layer, notifications about the conditions at your favourite places, and export of the logbook to a spreadsheet (CSV).

The notifications about conditions are sent as push notifications to your phone, and require that you have allowed the app to notify you. They are built on public measurement data and forecasts, which are perishable and can be delayed or wrong. We therefore cannot guarantee that a notification arrives, or that it arrives in time, and you should not plan a trip on the assumption that the app will tell you. You choose which notifications you want, and can turn them off again in the app.

8.1 Price and free trial

Premium costs 49 NOK per month or 399 NOK per year, and you choose the length yourself when you buy. New subscribers get a 7 day free trial. If you do not cancel before the trial ends, the subscription automatically becomes a paid subscription with the length you chose. The price may be displayed and charged in local currency and adjusted by the store for your country.

8.2 Payment and automatic renewal

Purchase and payment are handled by the App Store (Apple) or Google Play (Google), not by us. The amount is charged to your store account, and the subscription renews automatically one period at a time, that is one month or one year depending on the length you chose, until you cancel it. The renewal is charged during the last 24 hours before the current period ends. Purchases in the app are also subject to Apple's or Google's terms.

8.3 Cancelling the subscription

You can cancel the subscription at any time. It then runs to the end of the period you have already paid for, and does not renew. Cancellation is done in the store's settings:

• iPhone: Settings → tap your name at the top → «Subscriptions».
• Android: Google Play → your profile picture → «Payments and subscriptions» → «Subscriptions».

You will also find a shortcut to subscription management under «My premium» in the app.

8.4 Right of withdrawal and refunds

Premium is a digital service delivered immediately. By starting the subscription (including a free trial) you ask for delivery to begin at once, and you acknowledge that the statutory right of withdrawal lapses once the digital service has been delivered. Refunds are handled by Apple or Google under their own policies. If you want a refund you therefore need to contact the store you bought the subscription from. This does not limit any mandatory consumer rights you have under the law of the country where you live.

8.5 Changes to price and features

We may change the price or which features are included in Premium. Significant changes, such as a price increase, are announced in advance in the app or by email and take effect no earlier than the next renewal, in line with the stores' rules. You can always cancel before a change takes effect.

9. Closing your account

You can delete your account at any time from «Profile → Settings» in the app. When you delete the account, your data on the server is deleted as well, as described in the privacy policy. We may close or restrict an account that breaches these terms or misuses the service.

Note that an active Premium subscription is not cancelled automatically when you delete your account. The subscription is administered by the App Store or Google Play, so you also need to cancel it in the store to avoid further charges (see section 8.3).

10. Disclaimer

MinFangst is provided «as is» and «as available». We do our best to make the app work well, but cannot guarantee that it is error free or uninterrupted at all times. To the extent permitted by law, we disclaim liability for indirect loss arising from use of the app. Nothing in these terms limits the rights you have as a consumer under mandatory law.

11. Changes to the terms

We may update these terms, for example when the app gains new features. Significant changes are announced in the app or by email. Continued use after changes take effect counts as acceptance of the updated terms.

12. Governing law and disputes

These terms are governed by Norwegian law. If you are a consumer, this does not deprive you of the protection of mandatory rules in the country where you live, and you may always bring proceedings before the courts of that country. Consumers in the EU may also use the European Commission's online dispute resolution platform at ec.europa.eu/odr.

13. Sources and licences

The maps, measurements and species information in MinFangst are built on open data from public agencies and research institutions. Several of the sources require us to state where the data comes from, and they are listed together here.

Norwegian maps and measurements:

• The Norwegian Mapping Authority (Kartverket) provides the N50 map data, the place names, the depth data and the tidal predictions.
• The Norwegian Water Resources and Energy Directorate (NVE) provides the river network, the lake database, the lake depth charts and the measurements of water flow and water level.
• The Norwegian Environment Agency (Miljødirektoratet) provides the coastal water bodies and the register of anadromous salmonids, which the app uses to tell you whether a watercourse carries salmon or sea trout.

Swedish maps and measurements:

• Lantmäteriet provides the Topografi 50 map data.
• SMHI provides the Swedish Water Archive, which supplies lakes, rivers and sea areas, and the lake register the water temperature is calculated from.
• Vattenmyndigheterna and VISS provide the water bodies that the Swedish lake and coastal areas are built on.
• Statistics Sweden (SCB) provides the municipal and county boundaries.

The information about which fish species are documented in a body of water comes from GBIF (Global Biodiversity Information Facility), which collects observations from sources including the Norwegian Biodiversity Information Centre, systematic test fishing and electrofishing surveys, and the Swedish University of Agricultural Sciences test fishing registers. The data is licensed under CC BY 4.0. The downloads we build on are 10.15468/dl.cwna4g for Norway and 10.15468/dl.j3umq8 for Sweden.

Weather comes from the Norwegian Meteorological Institute and Open-Meteo. The drawn map is built on OpenFreeMap and the OpenStreetMap contributors, and the satellite imagery comes from Esri World Imagery and its suppliers.
